<br />e <br /> <br />e <br /> <br />7.2 Any individual who distributes, sells, attempts to <br />sell, attempts to purchase, or transfers illegal drugs <br />on City premises or while on City business will be <br />discharged or disbarred from the workplace and a report <br />made to law enforcement authorities. <br /> <br />'7.3 Any individual who is found to be in possession of <br />or under the influence of alcohol in violation of this <br />policy will be subject to discipline up to and <br />including discharge or disbarment from the workplace. <br /> <br />7.4 Any individual who is found to be in possession of <br />drug paraphernalia or other contraband items in <br />violation of this policy will be subject to discipline <br />up to and including discharge or disbarment from the <br />workplace. <br /> <br />7.5 Any individual who is found through drug testing <br />to have in his or her body system a detectable amount <br />of an illegal drug will be subject to discipline up to <br />and including discharge or disbarment from the <br />workplace. An employee who is discharged for having in <br />his or her body system a detectable amount of an <br />illegal drug may at the end of one year reapply for <br />employment and be considered, along with other <br />applicants, for whatever jobs might be available <br />consistent with the individual's qualifications. A <br />former employee so hired will be subject to periodic, <br />unannounced drug testing, and a confirmed positive test <br />finding will result in discharge without benefit of re- <br />hire. <br /> <br />7.6 Any individual who is found through alcohol <br />testing to have in his or her body system a volume of <br />alcohol which indicates legal intoxication in <br />accordance with the standard blood alcohol <br />concentration (BAC) test as recognized by the State of <br />Texas criminal law will be subject to discipline up to <br />and including discharge or disbarment from the <br />workplace. <br /> <br />7.7 Any individual who is convicted of a drug-related <br />felony crime, whether committed on or off duty, will be <br />discharged or disbarred from the workplace. <br /> <br />8. DRUG AND ALCOHOL TESTING OF JOB APPLICANTS <br /> <br />8.1 All applicants for employment will be subject to <br />drug and alcohol testing. <br /> <br />8.2 An applicant must pass the drug test to be <br />considered for employment. <br />
