<br />. <br /> <br />e <br /> <br />V. <br /> <br />FEES <br /> <br />Reasonable fees for the use of the building may be charged. <br />However, any fee having the effect of precluding or excluding low and <br />moderate income persons from using the facility are deemed excessive <br />and as such are expressly not allowed. <br /> <br />VI. <br /> <br />CHANGE OF USE <br /> <br />The city agrees that it will not change the use of the SPORT <br />Center for a period of ten (10) years after completion of construction <br />unless the city fully complies with the requirements of this section. <br /> <br />In effecting any change in use, of the SPORT Center, the City <br />shall provide the affected citizens with reasonable notice of such <br />change in use and allow them to an opportunity to comment on the <br />proposed change in use. Harris County through its Community <br />Development Agency must approve any proposed new use as being allowed <br />by the federal rules and regulations regarding community Development <br />Block Grant (CDBG) funds. Any change of use of the SPORT Center must <br />primarily benefit low or moderate income persons and any use of the <br />the SPORT Center for the general conduct of government is strictly <br />prohibited. <br /> <br />If within this ten (10) year period, the City, after consulting <br />the affected citizens, determines that it is appropriate for a use <br />that is not allowed for CDBG funds, then the City agrees that it will <br />reimburse the County in the amount of the then current fair market <br />value of the real property and improvements less any portion of the <br />actual original expenditure of funds by the City for acquisition of <br />and improvements to the property. <br /> <br />VII. <br /> <br />CONTRACT DOCUMENTS <br /> <br />This Contract includes the following exhibits and such exhibits <br />are attached hereto and made a part hereof for all purposes: <br /> <br />Exhibit A - CDBG Program Requirements <br />Exhibit B - Budget and Allocation of Costs <br />Exhibit C - Certification of Contracts, Grants, Loans <br />and Cooperative Agreements <br /> <br />4 <br />
