<br />e <br /> <br />e <br /> <br />Texas Department of Fealth <br />Division of Food and Drugs <br /> <br />RULES ,ON RETAIL FOOD STORE SANITATION <br /> <br />S229.23l. General Provisions. <br /> <br />(a) Purpose. These rules shall be liberally construed and applied to <br />promote the underlying purpose of protecting the public health. <br /> <br />(b) Definitions. The following words and terms when used in these <br />sections, shall have the following meanings unless the context clearly <br />indicates otherwise: <br /> <br />(1) Bulk food - unpackaged or unwrapped, processed or unprocessed <br />food in aggregate containers from which quantities desired by the consumer are <br />withdrawn. For the purpose of this interpretation, the term does not include <br />fresh fruits, fresh vegetables, nuts in the shell, salad bars and potentially <br />hazardous foods. <br /> <br />(2) Corrosion-resistant materials - those materials that maintain <br />acceptable sanitary surface characteristics under prolonged influence of the <br />food to be contacted, the normal use of cleaning compounds and sanitizing <br />solutions, and other conditions of the use environment. <br /> <br />(3) Display area - a location or locations, including physical <br />facilities and equipment, where bulk food, and other products, are offered for <br />customer self-service. <br /> <br />(4) Easily cleanable - that surfaces are readily accessible and <br />made of such material and finish and so fabricated that residue be effectively <br />removed by normal cleaning methods. <br /> <br />(S) Employee - the permit holder, individual having supervisory or <br />management duties, person on the payroll, family member, volunteer, person <br />performing work under contractual agreement, or any other person working in a <br />food store. <br /> <br />(6) Equipment -items other than utensils used in t1,e storage, <br />preparation, display, and transportation of food such as stoves, ovens, hoods, <br />slicers, grinders, mixers, scales, meat blocks, tables, food shelving, reach- <br />in refrigerators and freezers, sinks, ice makers, and similar items used in <br />the operation of a retail food store. This item does not include fork lift <br />trucks or dollies. <br /> <br />1 <br />
