<br />.0, <br />. . <br /> <br />. <br /> <br />ORDINANCE NO. 1749 <br /> <br />AN ORDINANCE APPROVING AND ADOPTING THE <br />RECOMMENDATION FOR SETTLEMENT OF THE PENDING <br />POWER COMPANY RATE CASE1 CONTAINING FINDINGS <br />RELATED TO THE SUBJECTJ FINDING COMPLIANCE <br />LAW1 AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />COALITION OF CITIES <br />HOUSTON LIGHTING & <br />AND OTHER PROVISIONS <br />WITH THE OPEN MEETINGS <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. Houston Lighting & Power Company has heretofore, on <br />November 9, 1990, filed with the City of La Porte a proposed <br />schedule of rates. The City Council of the City of La Porte, by its <br />Ordinance No. 1737, passed and approved on the 10th day December, <br />1990, denied Houston Lighting & Power Company's proposed schedule of <br /> <br />rates. <br /> <br />Section 2. The City of La Porte is a member of the Coalition <br /> <br />of Cities, which has recommended a settlement agreement with Houston <br /> <br />Lighting & Power Company, subject to approval by the Texas Public <br />utilities Commission, providing for a recommended $323,000,000.00 <br /> <br />rate increase. <br /> <br />Section 3. The City Council of the City of La Porte hereby <br /> <br />formally approves and adopts the settlement recommendation of the <br /> <br />Coalition of Cities, for a $323,000,000.00 rate increase for Houston <br /> <br />Lighting & Power Company, all as more fully set forth in <br /> <br />"Recommendation of the Regulatory Affairs Division on the Petition <br /> <br />of Houston Lighting & Power Company for Authority to Change Rates," <br /> <br />Executive Summary, dated January 23, 1991. <br /> <br />Section 4. <br /> <br />The City Council officially finds, determines, <br /> <br />recites and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br /> <br />posted at a place convenient to the public at the City Hall of the <br />City for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Article 6252-17, Texas Revised <br /> <br />Civil Statutes Annotated1 and that this meeting has been open to the <br /> <br />public as required by law at all times during which this ordinance <br />and the subject matter thereof has been discussed, considered and <br /> <br />formally acted upon. The City Council further ratifies, approves <br /> <br />and confirms such written notice and the contents and posting <br /> <br />thereof. <br />
