<br />e <br /> <br />e <br /> <br />City of La Porte <br />Personnel Policies <br /> <br />Failing the introductory period shall not be subject to any further review, except on the <br />grounds of discrimination prohibited by law, in which case the employee may request in <br />writing within five (5) working days following notice of their failure of the introductory <br />period the City Manager to review the matter. The decision of the City Manager shall be <br />binding and final. <br /> <br />SECTION 7 - REINSTATEMENT <br /> <br />A former employee may be eligible for reinstatement if any of the following conditions <br />apply. <br /> <br />1. The former employee is medically certified and capable to return to work. <br />Reinstatement shall be contingent upon availability of the same or similar <br />position as separated from, as well as continued ability to perform the <br />duties of the position. Prime consideration will be afforded these <br />individuals for twelve months following their nondisciplinary separation. <br />2. The employee is returning from a military duty leave of absence in <br />accordance with applicable State and Federal law. <br />3. The employee is being rehired after having been laid off. <br /> <br />The restoration of seniority or service credit upon reinstatement, if any, shall be <br />determined by the City Manager, Department Director, and the Human Resources <br />Manager. <br /> <br />An employee reapplying for employment after resigning or being terminated for reasons <br />other than stated above,shall follow the normal application process as outlined in Chapter <br />2. <br /> <br />SECTION 8 - NEPOTISM <br /> <br />No person related, within the second degree affinity, or within the third degree by <br />consanguinity, to the Mayor or any Council person or to the City Manager shall be <br />employed or appointed to any office, position" or clerkship of the City. This prohibition <br />shall not apply, however, to any person who shall have been employed for two (2) years <br />or more by the City at the time of the election or appointment of the officer to whom he <br />is related. (City Charter Provision 8.02, subsection c.) <br /> <br />The spouse (husband or wife) of an employee shall not be eligible for employment in the <br />same department. <br /> <br />No person shall be employed in any department who is related within the second degree <br />by affinity or within the third degree of consanguinity to a current employee in that same <br />department. <br /> <br />10 <br />
