Regular full time employees, hired prior to November 19, 1991, who <br />terminate under a benefits eligible status, after one year of employment <br />with the City, shall receive, upon separation, payment for accrued but <br />unused sick leave, not to exceed four hundred eighty (480) hours. <br />Twenty four hour shift personnel who terminate under the same <br />conditions as above, shall be paid for accrued but unused sick leave, not <br />to exceed seven hundred and sixty-eight (768) hours. All applicable tax <br />deductions will apply. . <br /> <br />Regular full time employees, hired November 19, 1991, and thereafter, <br />who terminate under a benefits eligible status, after ten (10) years of <br />employment with the City, shall receive, upon separation, payment for <br />. accrued but unused sick leave, not to exceed four hundred eighty (480) <br />hours. Twenty four hour shift personnel who terminate under the same <br />conditions as stated in this paragraph, shall be paid for accrued but <br />unused sick leave, not to exceed seven hundred and sixty-eight (768) <br />hours. All applicable tax deductions will apply. <br />6. An employee's designated beneficiary shall be paid eligible, accrued, and <br />unused sick leave, with the same stipulations as above, upon the death <br />of the employee. <br /> <br />SECTION 8 - MILITARY LEAVE <br /> <br />Military leave may be either military training leave or military duty leave (active duty). <br />Military training leave shall be leave with pay. Active duty shall be leave without pay. <br /> <br />An employee of the City and who is a member of the state military forces or a reserve <br />component of the armed forces is entitled to leave of absence from their duties on a day <br />on which the person is engaged in authorized training or duty ordered or authorized by <br />proper authority. During a leave of absence, the employee may not be subjected to loss <br />oftime, efficiency rating, vacation time,or salary. Leaves of absence under this paragraph <br />may not exceed 15 days in a federal fiscal year. (Texas Government Code, Section <br />431.005) <br /> <br />Regular employees who present official induction orders (drafted or reserve unit call up) <br />to enter the United States Armed Forces, the Texas National Guard, or the Texas State <br />Guard will be eligible for military duty leave without pay. At the time of military discharge, <br />the employee shall be reinstated at a position comparable to what the employee would <br />have attained had he not been on active duty. This shall include any promotions and/or <br />pay raises for which the employee would have been eligible had the employee been at <br />work instead of active duty.
