Box 1218 <br />La Porte, Texas 77572-1218 <br /> <br />Dear Mr. Askins: <br /> <br />This refers to the proposed 1991 redistricting plan <br />(Ordinance 1800) and the previously adopted 1991 redistricting <br />plan (Ordinance 1775) for the city council of the City of <br />La Porte in Harris County, Texas, submitted to the Attorney <br />General pursuant to section 5.of the Voting Rtghts Act of 1965, <br />as amended, 42 U.S.C. 1973c. We received your submission of the <br />plan enacted by Ordinance 1800 on December 23, 1991; that <br />submission also constituted your response to our request for <br />additional information regarding the plan enacted by Ordinance <br />1775. <br /> <br />with respect to the redistricting plan enacted by Ordinance <br />1800, the Attorney General does not interpose any objection to <br />the specified change. However, we note that Section 5 expressly <br />provides that the failure of the Attorney General to object does <br />not bar subsequent litigation to enjoin the enforcement of the <br />change. See the Procedures for the Administration of Section 5 <br />(28 C.F.R. 51.41). <br /> <br />with respect to the plan enacted by Ordinance 1775, that <br />plan now has been repealed and superseded. Accordingly, no <br />determination by the Attorney General is necessary or appropriate <br />concerning this matter. See also 28 C.F.R. 51.25 and 51.35. <br /> <br />Sincerely, <br /> <br />John R.
