<br />e <br /> <br />e <br /> <br />CITY, at the direction of the City Manager shall have the power to <br />remove or abate the same at the expense of the TELEPHONE COMPANY, <br />all without compensation or liability for damages to the TELEPHONE <br />COMPANY. TELEPHONE COMPANY shall promptly restore to as good <br />condition as before and to the reasonable satisfaction of the City <br />Engineer, all RIGHTS-OF-WAY damaged or excavated by the TELEPHONE <br />COMPANY. Should the CITY reasonably determine, wi thin one year from <br />the date of such restoration, that such surface requires additional <br />restoration work to place it in as good a condition as before the <br />commencement of the work, the TELEPHONE COMPANY shall perform such <br />additional restoration work to the reasonable satisfaction of the <br />CITY. Engineering plans for projects involving significant amounts <br />of new buried cable and underground conduit systems to be placed in <br />RIGHTS-OF-WAY shall be submitted to the City Engineer for review and <br />approval prior to construction. <br /> <br />(b) Except in an emergency, the TELEPHONE COMPANY shall not <br />excavate any RIGHT-OF-WAY without first notifying the city Engineer, <br />and, if approval is required it shall be given if the proposed <br />excavation is in compliance with the requirements of CITY <br />governance. The City Engineer or his designee shall be notified as <br />soon as practicable regarding work performed under emergency <br />conditions, and the TELEPHONE COMPANY shall comply with any <br /> <br />-13- <br />
