<br />. <br /> <br />e <br /> <br />purpose, under such terms and conditions as may lawfully be provided <br />by the City Council. This Section does not preclude the TELEPHONE <br />COMPANY from providing its tariffed services to cable television <br />companies. However, nothing herein shall authorize the TELEPHONE <br />COMPANY to license or lease to any cable television operator not <br />franchised by the CITY the right to use or utilize the TRANSMISSION <br />MEDIA or FACILITIES of the TELEPHONE COMPANY unless Federal or State <br />law allows such cable television operator to conduct its business <br />without first obtaining a franchise from the CITY. <br /> <br />SECTION 3 - DEFINITIONS <br /> <br />Whenever used in this Ordinance, the following words and terms shall <br />have the definitions and meanings provided in this Section: <br /> <br />(a) FACILITIES: all TELEPHONE COMPANY duct spaces, manholes, poles, <br />condui ts , underground and overhead passageways, and other <br />equipment, structures and appurtenances and all associated <br />TRANSMISSION MEDIA. <br />(b) USE: any TELEPHONE COMPANY acquisition, construction, <br />reconstruction, maintenance or operation of any FACILITIES in, <br />over, under, along, through or across the public RIGHTS-OF-WAY <br /> <br />-5- <br />
