<br />e <br /> <br />. <br /> <br />SPECIAL TERMS AND CONDITIONS <br /> <br />LENGTH OF CONTRACT <br /> <br />The terms of the contract shall be for a period o,f sixty (60) <br />working days inclusive of weekends and holidays. <br /> <br />TERMIJlATION OF COJn'RACT <br /> <br />1. Should it be necessary to terminate this contract, with or <br />wi thout cause, for any reason, t!=!n (10) days notice by <br />. certified mail to the Contractor by the City of La Porte shall <br />constitute no~ice anq ~e~~i~atio~. <br /> <br />2. Should the Contractor fail to co~plete all specified work <br />within the sixty (60) days allocated by the contract, the City <br />shall require the Contractor to pay a daily penalty of fifty <br />dollars ($50.00). Said penalty shall be paid for each day <br />beyond the specified contract period necessary for job <br />completion. . <br /> <br />3. Right to Assurance. Whenever the City in good faith has <br />reason to question the Contractor's intent to perform, the <br />'City may demand that the Contractor give written assurance of <br />his intent to perform. In the event that a demand is made and <br />no assurance is given within five (5) days the City may treat <br />this failure as an anticipatory repudiation of this contract. <br /> <br />WORK TO BE PERFORMED <br /> <br />1. All foundations, base walls, and steps must be completely <br />removed, and all basements, if any, shall receive a complete <br />solid fill; and foundations, slabs, piers and beams must be <br />removed from the site. All materials, fixtures, and debris <br />shall be removed from the site, except as herein provided, and <br />the entire parcel shall be left in a clean and orderly <br />condition. The site shall be filled and graded as needed to <br />prevent water from accumulating and stagnating. Compliance <br />inspections will be made by the Inspection Division. <br /> <br />2. Notwithstanding the fact that a particular lot or parcel has <br />been designated for demolition and clearing operations, the <br />Contractor shall not enter upon or begin clearance work upon <br />ariy lot or parcel which appears to have been recently cleared <br />or is in the process of being cleared by the landowner, his <br />agent, employee or independent contractor; instead, Contractor <br />shall immediately inform the Inspection Division of such <br />finding and move on to the next designated lot unless <br />otherwise directed by same. <br />
