As a part of the Study, the existing aeration equipment was determined to have reached
its useful life (20+ years) and should be replaced. The current CIP budget includes funding of
$625,000 for the replacement of this equipment.

PBS&J, Inc. completed design and the city received four (4) bids for the Project. Low bid was
submitted by two (2) contractors, T &C Construction, L TD and Craig, Sheffield & Austin - both
contractors bidding $520,000.00. Copies of the Bid Proposals from both firms are attached. The
Engineer reviewed the bids, previous project performance of both bidders, major subcontractors
(both propose to use Pfeiffer & Sons) and equipment suppliers (both propose to purchase from
US Filter/Zimpro). The Engineer could find no material difference in the bids, and recommends
that the City select either of the two low bidders.

After discussing the issue with the Purchasing Manager (no guidance in the existing Purchasing
Manual), it was decided to invite representative of both bidders and the Engineer to the Public
Works Director's office, where, witnessed by the Director and the Purchasing Manager,
representatives would cut a new deck of playing cards for high card. On Friday, March 04, 2005
at 2:00 pm, high card was drawn by T &C Construction Gack of hearts over a 7 of diamonds).

Action Required bv Council: Approve an Ordinance authorizing the City Manager to execute a
Contract with T&C Construction for Aeration Equipment Replacement at the Little Cedar Bayou
Wastewater Treatment Plant in the amount of $520,000.00, and a 5% contingency of $26,000.

Approved for City Council Ag:enda

D~'~~D~~Jdi

-----' 3-)-05

Date
