Texa~ (herein referred to as the ..c iIY"). <br /> <br />The Property: Thi~ Agreement concerns th~ following hmd and buildings lher~on: <br />Lots 1.2.3.4.5.6. II, 12, 13. 14, 15 and 16 and Adjaccnt 16' Alley. Block Eighteen (18). <br />of Sylvan Beach Addition. Harris County. Texas. according to the map ot plat thereof <br />recorded in Volume 3. Page 72 of the Map Reconls of Harris County. Texas commonly <br />known as 200 Garfield, LaPorle, Texas (herein referred to 30:\ the "Pl'Opel.ty") and fmother <br />concC1'IlS Cause No. 2004.23652; 200 Garfield LLC v. City ofLap071C. Texas; in the 113lh <br />Judicial Distric;:t COij.rt. Ha~s Counly, Texas (herein referred to as the "Lawsuit"). <br /> <br />The City of La Pnrlc agrees: <br /> <br />1. ThaI at [h~~ first City Council meeting after the approval of thi!; <br />Settlement Agreement, the City shall repcal all of its Ordinancc!\l <br />calling for the demolition of buildings on the Property~ <br /> <br />2. Tha[ prior to Janual'Y 2. 2006. the City !\hall not enact any ordinances <br />requiring demolition of the existing buildings on lh~ Property or <br />'otherwise seek to have the exisling buildings on the Property <br />demolished; <br /> <br />3. The City shall process and decide any application I'cceivcd from. 200 <br />Garfield. LLC rela.ting to proposed construction of new buildings or <br />renova.tion of the existing buildings on the Property. promptly. in good <br />failh and with its bc:-;t cffort!\. and sha.ll schedule any !'equired <br />inspections promptly. in accordance with its customary practIce!\; <br /> <br />4.
