The request, submitted by Mr. Randall Jones, <br />seeks approval of a Special Conditional Use Permit (SCUP) for developing climate control mini-storage, boatlR V storage, <br />car wash and commercial reserve A, approximately 5.4362 acre tract ofland located in the 1200 Block of South 13lh Street <br />between West "K" and "L" Streets. Mini-storage/warehousing within a General Commercial zone requires Conditional Use <br />per Chapter I 06; Zoning. <br /> <br />The property is surrounded by commercial developments i.e. professional offices, restaurants, medical center, banks etc. La <br />Porte Comprehensive Plan envisions this area to be developed as major commercial center near Fairmont Parkway and <br />State Highway 146. Previous SCUP submitted in 2004 included commercial center with office development and was more <br />conforming to the land use map and intent for this area. The current plan will be developed in phases. First phase shows <br />development of car wash and climate control mini-storage. Mini-storage/warehousing will be extended during the second <br />phase. The southeast portion, 34,160 sq.ft. of the subject tract, will be developed as commercial/retail center in phase three. <br />In addition, 2.5 acres of reserve B is restricted for future commercial/retail activities. Mini-storage and warehousing use <br />may not be a key economic generator in TIRZ but may contribute towards property taxes. However, the planned future <br />commercial center is more compatible with the existing facilities abutting this property. The adding of the commercial <br />restrictions in Reserve A and Reserve B improves this project over the 2004 SCUP. <br /> <br />Thirteen notices of public hearing were mailed to neighboring property owners. Three responses were received. At the conclusion of the <br />public hearing, the Commission agreed with the staff's statement and added a condition to the SCUP that the owner/developer may not <br />expand the mini-storage use into any remaining tracts restricted for commerciallretail in blocks 1136 and all of block 1135 (Reserve B) as <br />outlined in the General Plan, The Planning and Zoning Commission recommends City Council approval of Special Conditional Use <br />Permit #SCU05-006 with the following conditions: <br />l. This SCUP is specifically for a proposed development on Blocks 1136 & 1137. <br />2. Developer will work with the City to address the drainage corridor and realignment of S.121h Street ROW. <br />3. Additional landscaping shall be required along K Street right-of-way. <br />4. South 13lh Street should be extended to and through of the proposed development consistent with PICM. <br />5. Utility extension or paved area over drainage corridor will be the responsibility of the owner/developer. <br />6. Enhance the building farrade so that it blends with Ihe existing commercial to be aesthetically pleasing. <br />7. Detention basin shall be screened and landscaped in compliance with required screening and landscaping provisions per <br />Section 106-444(a) of the Ordinances. <br />8. Provide an irrigation system to ensure that all landscaping is properly maintained by the owner/developer. <br />9. Ensure that maximum lot coverage does not exceed 40%. <br />10, This permit does not become valid until a Development Site Plan is submitted to the City; reviewed and approved in <br />accordance with the requirements of the Development Ordinance. <br />11. Developer shall comply with all other applicable laws and ordinances of the City of La Porte and the State of Texas. <br />12. The applicant may not expand the current development and use (mini-warehouse and car wash) into any remaining tracts under <br />his ownership or control and is only permitted to develop commerciallretail activities in the commercial reserve in Block 1136 <br />as outlined in the General Plan and in Block 1135. Any development in the stated tracts must conform to uses permitted in the <br />General Commercial Zoning District per the Zoning Ordinance. Any deviation of use will require a new Special Conditional <br />Use Permit and General Plan. <br /> <br />Action Required bv Council: <br />1. Conduct public hearing. <br />2.
