<br /> <br />e <br /> <br />City of La Portee <br />Established 1892 <br /> <br />April 25, 2005 <br /> <br />Hon, Mayor Alton Porter and City Council <br />City of La Porte <br /> <br />Re: Zoning Ordinance Amendment - Truck Stops <br /> <br />Dear Mayor Porter: <br /> <br />The La Porte Planning and Zoning Commission, during a regular meeting on April 21, 2005, held a <br />public hearing to consider amendments to the Zoning Ordinance (Chapter 106), Section 106-521; Table <br />A., Industrial Uses, to amend, change or modify conditions to allow truck stops in a Business Industrial <br />(BI) zoning districts, <br /> <br />After a careful consideration, the Planning and Zoning Commission, by a 4-1 vote, forwarded <br />their official position for action by City Council that the present conditions should remain as it is <br />in Chapter 106 (Zoning). <br /> <br />While the Commission appreciated the work done by staff in preparing the amendment to the <br />ordinance, it was felt that the adverse impact that truck stops adjacent to a residential zone (air <br />pollution, noise, light, and quality of life) would necessitate maintaining the current system offered <br />by the Special Conditional Use Permit process. In this manner, the Commission and Council could <br />benefit by a thorough examination of all factors impacting upon the residents of La Porte. The <br />Commission believes that the use of SCUP fulfills the spirit of the Comprehensive Plan and the <br />Zoning Ordinance..It was the majority's opinion that the amendments to the zoning ordinance not <br />be accepted. <br /> <br />We realize that Council is anxious to encourage economic development for increased revenue, but <br />we think this plan as presented would provide too many possibilities of an undesirable use with not <br />enough control.
