(a design/build firm) petitioned before the Planning <br />and Zoning Commission, for Special Conditional Use Permit #05-002 for developing Underwood Business Park <br />containing offices, warehousing and distribution uses in a PUD. Per Section 106-637, this development requires a <br />General Plan with a Special Conditional Use Permit. <br /> <br />This site consists of approximately 208 acres located to the south of the Battleground Industrial Estate at 101 Old <br />Underwood Road. The city limits of La Porte lines run parallel to the property line along west side of Old Underwood <br />Road. The Battleground Industrial Estate Phase II is located across the street to the west in the City of Deer Park. At the <br />site in question, the developer is proposing office/warehouses and Distribution Center with associated detention in Phase <br />1. Future development of proposed tracts will be in Phase 11 as additional clients are identified. The facility would have <br />entrance along Old Underwood Road access through East BID Street and SH 225. This facility will be partially rail <br />served. Each phase of the project would require subsequent SCUPs and plats/plans would be approved separately. <br /> <br />The City's Comprehensive Plan shows this area developing with industrial uses. The existing land uses of nearby <br />properties are primarily industrial (the Battleground Industrial Estate Phase I & J1, the Battleground Industrial District). <br />This development borders Houston Associates (Industrial) and S.H. 225 to the North, Old Underwood Road to the West, <br />a 150' Centerpoint Energy Easement (PUD) to the South and Southern Pacific RaiVS.H. 225 to the East. This area is <br />sufficiently buffered for this type of development. . <br /> <br />During the discussion of the development with P&Z, two items on the draft SCUP were deleted and/or changed. This <br />project, given that it is buffered to the South by a 150' easement within a PUD zone belonging to Centerpoint, will not <br />incur the landscaping requirements when bordering residential zones. While the project itself may have up to 30% <br />coverage for landscaping, the applicant indicated he wanted to be bound by the normal requirements of the ordinance. <br />The landscaping percentage was changed by P&Z from 30%to the required 6%. <br /> <br />Staff feels that this project represents a significant impact to economic development within the City of La Porte. <br />Based on the above analysis, staff recommends approval of the general plan for this 208 acres tract and the Special <br />Conditional Use Permit with the listed conditions. <br /> <br />There were six (6) mail-outs, and no responses. By unanimous vote, P&Z recommends approval of SCUP #05-002. A <br />Public Hearing is required. <br />
