<br />e <br /> <br />e <br /> <br />- 7 - <br /> <br />8. DISCIPLINE <br /> <br />Any employee who uses, possesses, manufactures, distributes, sells, attempts to sell or <br />transfers illegal drugs on City premises or on City business will be immediately discharged. <br />Any contractual employee who uses, possesses, manufacture~, distributes, sells, attempts <br />to sell, or transfers illegal drugs on City premises or on City business will be immediately <br />banned from the job site. <br /> <br />Any employee who refuses to undergo biological testing, adulterates the specimen or <br />substitutes the specimen will be immediately discharged. Any contractual employee who <br />refuses to undergo biological testing, adulterates the specimen or substitutes the specimen <br />will be immediately banned from the job site. <br /> <br />9. REHABILITATION <br /> <br />The City considers illegal drug or alcohol abuse a self-induced illness and will not provide <br />financial assistance to treat it. <br /> <br />The City will provide to employees information conceming substance abuse treatment <br />programs. Information concerning both publicly and privately funded local community <br />resources will be made available. <br /> <br />10. APPEALS <br /> <br />An employee whose bioloQical test is reported positive will be asked in a confidential <br />meeting with the City's contracted Medical Review Officer to offer an explanation. The <br />purpose of the meeting will be to determine if there is any reason that a positive test could <br />have resulted from some cause other than illegal drug or alcohol use, that is in violation of <br />this policy. <br /> <br />The employee may have the remaining portion of the urine specimen tested by an <br />independent lab, at hislher own expense. Additionally, the employee may have the test <br />results reviewed by a licensed physician with knowledge of substance abuse disorders, at <br />hislher own expense. <br /> <br />An appeal that merits further inquiry may require that the employee be suspended without <br />pay until the inquiry and the appeals process are completed. If the conclusion of the <br />appeal is in the employee's favor, the employee will be. reinstated withOtit payment for <br />wages lost during suspension. <br />
