<br />. <br /> <br />EXHIBIT "A" <br /> <br />e <br /> <br />ARTICLE III. WATER AND SANITARY SEWER SERVICE CHARGES <br />DIVISION 4. UTILITY DEVELOPMENT FEES <br /> <br />Sec. 74-280. Definitions <br /> <br />Actual cost is the cost of off-site water lines or sanitary sewer line extensions as was <br />paid by the city or developer for the contractor to complete the project. <br /> <br />Developer is a person, firm or corporation, whether one or more or a combination of <br />one or more, that improves, sells or uses land for the purpose of constructing <br />residential, commercial or industrial buildings thereon to be sold or leased to others, or <br />for personal use. <br /> <br />Development fees are the monetary fees paid for each dwelling, lot, tract, or parcel <br />of land per the schedule of fees found in Exhibit B attached hereto, incorporated for <br />reference herein and made a part hereof for all purposes. <br /> <br />Off-site extension is an extension of water lines or sanitary sewer lines that are <br />totally outside a tract of land to be subdivided and/or developed. <br /> <br />Sanitary sewer lines are the sanitary sewer mains, laterals, sanitary sewers, lift <br />stations, and pump stations located in public streets and easements. <br /> <br />Tap fees are the fees paid for a metered water service connection or a stack fee for <br />sanitary sewer service. <br /> <br />Tract acreage is the total acreage that can be served by the off-site extension, Le., <br />the total acres or parcels of land that can be served on the extension as shown by a <br />project service area map to be prepared by the planning department prior to <br />construction of the extension. <br /> <br />Water lines are the water mains, service lines, fire hydrants, and appurtenances <br />located in public streets and public easements. <br /> <br />Sec. 74-281. City to construct water and sanitary sewer lines only in public <br />rights-of-way, or easements. <br /> <br />The City shall construct or cause to be constructed water and sanitary sewer <br />laterals, mains, and facilities under the provisions hereof only in public rights-of-way or <br />easements. All such laterals, mains and facilities when constructed shall remain the <br />property of the City of La Porte, and no person shall, by the payment of the <br />development fee, or any other means, acquire any interest or right in any laterals, <br />mains, or facilities, or any portion thereof, other than the privilege to have their property <br />connected thereto for water and/or sanitary sewer service in accordance with the <br />Ordinances of the City. <br /> <br />1 <br />
