Joems, Acting City Manager <br />Date: February 6, 2003 <br />Re: Dangerous Building Inspection at 618 South Iowa St., La Porte <br /> <br />At the request of the Acting City Manager, I have reviewed the inspection procedures <br />employed by the Dangerous Buildings Committee in connection with all 14 structures <br />that exist within your agenda packet this evening. After consultation with the Acting <br />City Manager and members of the Committee in connection with the inspection <br />procedures employed, I am concemed that we might have a procedural issue in <br />connection with the inspection employed at 618 South Iowa Street. It is possible that <br />the inspector exceeded his authority to enter the structure to perform the inspection. <br /> <br />Therefore, out of an abundance of caution, I recommend that the City Council not <br />take action on the ordinance authorizing demolition of the structure at 618 South <br />Iowa Street, until the Dangerous Building Committee is able to reinspect the <br />premises. <br /> <br />My review of the inspection procedures employed at all 13 other structures reveals <br />no deficits at all in the inspection process, as the structures were either totally <br />unsecured and open, were visually inspected from the exterior and determined to be <br />dangerous via such inspection if the premises were secured, or were inspected <br />intemally via the consent of the owner of the premises. Thus, from a procedural <br />standpoint, I am quite comfortable recommending consideration of passage of the <br />other 13 ordinances by the City Council. <br /> <br />. Page 1 <br />
