<br />. <br /> <br />e <br /> <br />RESOLUTION NO. 93-04 <br /> <br />A RESOLUTION URGING THE GOVERNOR AND LEGISLATURE OF THE STATE OF <br />TEXAS TO ADOPT AND ENACT LEGISLATION PROVIDING CAPITAL PUNISHMENT <br />FOR PERSONS WHO ABUSE AND MURDER CHILDREN, AND PROVIDING AN <br />EFFECTIVE DATE <br /> <br />WHEREAS, the City Council of the City of La Porte, Texas, has <br />determined that Texas is experiencing an overwhelming problem with <br />child abuse which ultimately leads to the death of the abused <br />child; and <br /> <br />WHEREAS, though child abuse alone is a horrendous crime which <br />should carry a heavy penalty, child abuse resulting in death is a <br />crime deserving of extraordinary punishment; and <br /> <br />WHEREAS, the Texas Penal Code does not provide for capital <br />punishment for persons whose abuse of a child leads to the death of <br />that young victim; and <br /> <br />WHEREAS, the City Council desires to urge State lawmakers to <br />adopt legislation that would provide for capital punishment for <br />those convicted of killing a child in the course of or following a <br />period of abuse of the victim. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE, TEXAS: <br /> <br />Section 1. That the City Council of the City of La Porte, <br />Texas, urges the Texas LegiSlature and the Governor to enact <br />specific legislation that will provide capital punishment for <br />anyone who takes the life of a child if it is found that the <br />killing occurred during the course of or following a period of <br />physical abuse of the child by the defendant. <br /> <br />Section 2.
