<br />. e <br />ORDINANCE NO. 2004- J73 g <br /> <br />AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A <br />PORTION OF FAIRMONT PARKWAY WITHIN THE CORPORATE LIMITS OF LA <br />PORTE; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; PROVIDING A <br />SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS <br />LAW; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the State Department of Highways and Public Transportation has <br /> <br />made it known to the City of La Porte that operations will begin in the near future to make <br /> <br />improvements along Fairmont Parkway; and <br /> <br />WHEREAS, upon the basis of an engineering and traffic investigation, the State <br /> <br />Department of Highways and Public Transportation has requested the City of La Porte, <br /> <br />upon authority vested in said City in Texas Transportation Code Sec. 545.356(b) t<;> <br /> <br />establish a temporary construction speed zone during the construction period of said <br /> <br />improvements; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE: <br /> <br />Section 1. That a construction speed zone be established along the named <br /> <br />street or parts thereof described as follows: <br /> <br />Along Fairmont Parkway between Bay Area Boulevard and South 16th <br /> <br /> <br />Street, a distance of approximately 0.66 miles, a temporary speed limit of 35 <br /> <br />MPH, shall be in effect when so signed within said zone. <br /> <br />Section 2. Necessary signs for posting the speed zones will be furnished, <br /> <br />installed, and maintained by the direction of the State Department of Highways and Public <br /> <br />Transportation engineer in charge of the project. <br /> <br />Section 3. Any person violating the provisions of this ordinance shall, upon <br />conviction, be fined in any sum not to exceed Four Hundred Dollars ($400.00). <br />
