<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 2004-2736 <br /> <br />AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES OF THE <br />CITY OF LA PORTE BY AMENDING CHAPTER 2, "ADMINISTRATION," ARTICLE II <br />"FINANCE", DIVISION 2. "PURCHASES AND CONTRACTS", SECTION 2.81, <br />"AUTHORITY OF CITY MANAGER TO CONTRACT FOR EXPENDITURES; LIMITS", <br />BY INCREASING THE CITY M~NAGER'S EXPENDITURE LIMIT FROM $5,000.00 TO <br />$25,000.00; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING <br />A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE THEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />Section 1. That Chapter 2, "Administration," Article II, "Finance", Division 2, <br /> <br />"Purchases and Contracts", Section 2.81,"Authority of City Manager to Contract for <br /> <br />Expenditures; Limits" is hereby amended and shall now read as follows: <br /> <br />Sec. 2-81. Authority of city manager to contract for expenditures; limits. <br /> <br />Pursuant to the provisions of Charter section 5.02 regarding purchase procedure, <br />the city council hereby confers upon the city manager general authority to <br />contract for expenditures, without further approval of the city council, for <br />budgeted items not exceeding $25,000.00. All contracts for expenditures <br />involving more than $25,000.00 must be expressly approved in advance by the <br />city council. <br /> <br />SECTION 2. The City Council officially finds, determines, recites and declares that a <br /> <br />sufficient written notice of the date, hour, place and subject of this meeting of the City <br /> <br />Council was posted at a place convenient to the public at the City Hall of the city for the <br /> <br />time required by law preceding this meeting, as required by the Open Meetings Law, <br /> <br />Chapter 551, Texas Government Code; and that this meeting has been open to the public <br /> <br />as required by law at all times during which this ordinance and the subject matter thereof <br /> <br />has been discussed, considered and formally acted upon. The City Council further ratifies, <br /> <br />approves and confirms such written notice and the contents and posting thereof. <br />
