Water Service Agreement Extension Budgeted Item: _YES ..LNO SUMMARY & RECOMMENDATION Summarv: The City is in the process of reviewing cunent utility service agreements with its industtial district customers to detennine which agreements have expired or are due to expire within the coming months. Air Liquide America Corp. has an Industrial District Agreement (IDA) with the City that is valid through December 31, 2007. However, the teon of its current Water Service Agreement (WSA) with the City expired on July 28, 2002. It is the City's desire to create concurrent terms for both of the agreements. In order to achieve this, renewal of Air Liquide America Corp. 's WSA will be considered at the time of its IDA renewal in January of 2008. It is anticipated that each agreement will share the same seven (7) year teon depending on the City's ability to continue to supply water. Staff has contacted Air Liquide America Corp. regarding extending the current teon of its WSA The Company is agreeable to the extension of its cunent WSA through December 31,2007. Recommendation: Staff recommends approval of an ordinance to extend the CWTellt teon of Air Liquide America Corp.'s Water Service Agreement through December 31, 2007. Action Reouired of Council: Consider approval of an ordinance authorizing the City Manager to enter into an agreement with Air Liquide America Corp. to extend the terms ofits current Water Service Agreement through December 31, 2007.
