RetT <br />Chief of Police <br /> <br />To: <br />From: <br />Date: <br /> <br />Clark Askins, Assistant City Att~~r <br />Richard Reff, Police Chief ~ <br />03/08/04 <br /> <br />Conflict in the Ordinance <br /> <br />Debra Feazelle <br />City Manager <br /> <br />Subject: <br /> <br />You asked me to look into the matter of the speed limit on L Street as indicated by our <br />Ordinances, to determine if there are any errors and what steps need to be taken regarding the <br />speed limit on L Street. <br /> <br />Upon reviewing Ordinance 70.- 101 Thirty-five mile an hour zones and comparing it to <br />Ordinance 70 -102 Forty mile an hour zones I found that there is a conflict between these <br />Ordinances as they affect the speed limit on L Street. <br /> <br />70-101 (4) establishes a thirty-five mile an hour zone from, along North L Street, form a point <br />545 feet east of Alvy Lane to the east right-ol-way line of Underwood Road, a distance of 7,542 <br />feet, 1.42 miles. Which simply means that from Underwood to a point 545 feet east of Alvy Lane <br />the speed limit is 35MPH. <br /> <br />70-102 (3) establishes a forty mile an hour zone from, along North L Street from Underwood <br />Road to a point 850 feet west of Lomax School Road, a distance of 4,000 feet, 0.76 miles. Simply <br />stated this creates a forty mile an hour zone from Underwood to a point 850 west of Lomax <br />School Road. This is the conflict in our Ordinance. The 4,000 feet indicated is in the 7,542 feet <br />area designated as a 35 MPH zone. <br /> <br />70-102 (4) establishes another forty mile an hour zone, along North L Street, from a point 2,750 <br />fiet east of Lomax School Road to 2(/h Street, a distance of 5,500 feet, 1.04 miles. Simply stated, <br />there is a forty MPH zone from Sens to a point 2,750 feet west on L Street. <br /> <br />I have requested the Engineering Department to look at this issue to confinn that the point 545 <br />feet east of Alvy Lane and 2,750 feet west of Sens is the same spot. At this point there should be, <br />and is, a sign indicating 35 MPH to westbound traffic and 40 MPH to eastbound traffic on North <br />L Street. Engineering confirmed that they are the same point. They also plotted 70-102(3) and <br />finds that it overlaps the zone established by 70-101(4). <br /> <br />I recommend that we delete Ordinance 70-102(3) to rectify this situation. <br />
