The <br />request, submitted by Lloyd and Linda Duncan, seek approval of a Special Conditional Use Permit <br />(SCUP) to build a mini-storage facility on approximately 4.00 acre tract ofland near the intersection of <br />Underwood Road and Spencer Highway. The property is further described as lot 10, block 2, of the W. <br />J. Payne Subdivision, La Porte, Harris County Texas. Mini-storage/warehousing within a General <br />Commercial zone requires Conditional Use per Ordinances. <br /> <br />The property is surrounded by major retail commercial developments and residential in the rear. The <br />proposed use is considered to be inappropriate due to the nature of retail commercial establishments in <br />the vicinity and close proximity of residential in the rear. The developer is willing to blend this <br />development architecturally and aesthetically with the surrounding properties. The activity was not <br />considered compatible, however, by the Planning and Zoning Commission. <br /> <br />Thirteen (13) notices of public hearing were mailed to neighboring property owners. One response <br />was received. The Planning and Zoning Commission, by a vote of five (5) in favor, one (1) opposed <br />(Dottie Kaminski), and one (1) abstained (R.J.Dorsett), recommends that City Council consider <br />disapproval of Special Conditional Use Permit #SCU04-004. <br /> <br />City Council may affirm the Commission's recommendation to disapprove the SCUP. This would be <br />voting against the proposed ordinance and requires only a simple majority. City Council may overrule <br />the Commission's recommendation and approve the SCUP. This would be voting in favor of the <br />proposed ordinance and requires a minimum of seven affirmative votes (3/4 rule). <br /> <br />Action Reauired bv Council: <br />1. Conduct public hearing. <br />2. Consider taking action on recommendation for denial by P&Z for 4.00 acres ofland located at <br />2619 Underwood Road.
