In addition, the Port is planning an integrated themed <br />landscape along Barbour's Cut Boulevard. These issues will be <br />discussed in detail when the Commission receives a request for a <br />Special Conditional Use Permit (SCUP). <br /> <br />Based on the above analysis, Staff finds the requested change is <br />compatible with the zoning and uses of nearby properties. The tract in <br />question is suitable for the requested change to PUD making an <br />environment conducive for the Port of Houston Authority's expansion <br />project. It would not have a significant impact on traffic conditions in <br />the area and utilities would not be affected. Development within the <br />subject tract should not negatively impact the surrounding properties <br />and should not harm the value of nearby properties. <br /> <br />By acting on this item, the Commission is simply approving or denying <br />the rezone request and forwarding their recommendation to the Council <br />for consideration. The Commission's action does not approve the <br />facility. The Port must still obtain approval from the Council to close <br />various streets and alleys. In addition, the Port must also receive <br />approval from the Commission and Council for the SCUP. When the <br />project progresses to the SCUP and site plan process, the Commission <br />may take additional steps to ensure that land uses, landscaping, lighting, <br />setbacks, and other items are considered. <br /> <br />In reviewing this request the Commission should consider the following <br />points: <br /> <br />. There was no apparent error in assigning the present zoning (BI) <br />designation to the tract in question. <br />. The applicant's requested zoning to PUD provides some <br />flexibility for the developer while at the same time allowing the <br />City to review specific uses and site layouts at the various stages <br />of the proposed development. <br /> <br />Options available to the Commission are: <br /> <br />. Recommend to Council approval of this rezoning request from <br />BI to PUD. <br />. Recommend to Council denial of this rezoning request from BI <br />to POO. <br />. Continue the public hearing at the Commission's next regular <br />meeting to allow additional testimony and further study of this <br />item. This results in tabling any action on this item. <br />
