This request involves approximately 20.7 acres located on East <br />Barbour's Cut Boulevard. (See Exhibit C.) As the owner of this property, the Port of Houston Authority is requesting a <br />rezone from Business Industrial (BI) to Planned Unit Development (PUD). The Port is proposing a truck pre-check <br />facility with 14 truck lanes. (See Exhibit D.) Currently, this proposed facility is not permitted in the BI zoning district. In <br />the PUD district, all uses are permitted; however, the Planning and Zoning Commission and Council determine if the use <br />is appropriate/compatible with the existing land use and the City's Comprehensive Plan. (See Exhibit E.) The <br />Commission and Council may also place specific conditions and controls on that use/activity. <br /> <br />This request is the first step that the Port must take prior to developing this facility. The Port understands that additional <br />approvals, from Council regarding street and alley closures, and approval of a Special Conditional Use Permit (SCUP) <br />and site plan from the Commission and Council, must also occur. During the regular meeting, the Planning and Zoning <br />Commission also acknowledged that during these processes, additional requirements regarding lighting, landscaping, and <br />buffering the nearby residential from the facility will be discussed and incorporated into the plans. <br /> <br />As required by ordinance, twenty-three (23) notices of public hearing were mailed to property owners within 200' of the <br />site. In addition, Staff obtained the mailing list used by the Port when they held their community meetings this past spring. <br />After accounting for duplicates, nine (9) additional notices were mailed to property owners within 500' of the site. This <br />ensured that the property owners invited to the Port's community meetings also received public notice ofthe rezone. Staff <br />received a total of four (4) responses, which were all in favor of the rezone. The responses are attached as Exlubit F. <br /> <br />By a unanimous vote during their regular meeting, the Commission recommended to Council approval of Rezone Request <br />#R 02-002. The following options are available to Council: <br /> <br />. Table the item until a specified future meeting date. <br />. Approve the Commission's recommendation with a simple majority. <br />. Disapprove the Commission's recommendation with a % majority. <br /> <br />Action Required bv Council: <br />I. Conduct public hearing. <br />2.
