The property owner, the Port of Houston Authority, seeks to construct a 14 lane Pre-Check <br />Terminal, This item was tabled several times to give Council time to review documents and obtain clarification about the <br />inclusion of all property in the Home Owner's Value Assurance Program Resolution, <br /> <br />During their July 28, 2003, the Port Commission approved the amended Property Owner's Value Assurance Program <br />Resolution. On July 29th, Port officials sent a signed resolution to the City for review, Council is asked to consider <br />approval of the General Plan/layout, all supporting documents, and Special Conditional Use Permit SCU#03-001 with the <br />following conditions: <br /> <br />1. <br />2. <br /> <br />Adhere to the terms of the Property Owners Value Assurance Program (as described in Exhibit F-l), <br />Sign an interlocal agreement with the City of La Porte regarding the Property Owner's Value Assurance <br />Program, <br />Comply with the General Plan approved by the City as shown in the attached Exhibit F-2, <br />Ensure that at least 30 percent of the property consists oflandscaping and/or screening. <br />Provide detailed landscape and screening plans during site plan submittal, Allow existing trees and shrubs to <br />remain as natural buffer. Provide "in fill" plantings of trees and shrubs, <br />Provide an irrigation system to ensure that all landscaping and screening is properly maintained by the <br />owner/developer. <br />Erect a sound wall constructed with a "rough" texture to decrease the likelihood of graffiti and to increase the <br />likelihood that vines/greenery will attach to the wall. <br />Adhere to the provisions and details shown in facilities lighting plan. Ensuring that all illumination occurs on <br />site and does not affect nearby residences. <br />Enhance the building fa~e so that it is architecturally and aesthetically pleasing, The Planning and Zoning <br />Commission must approve the design, <br />Prohibit the overnight parking of trucks at the facility between 6 pm and 6 am, <br />Hours of operation shall be no earlier than 7 am and no later than 6 pm, <br />Pay the public hearing costs. <br />Comply with all other applicable laws and ordinances of the City of La Porte and the State of Texas. <br /> <br />.
