e e It shall be unlawful for any industrial user to discharge wastewater into the POTW without first obtaining a wastewater discharge permit from the Director. Any violation of the terms and conditions of a wastewater permit shall be deemed a violation of this ordinance and subject the wastewater discharge permittee to the sanctions set out in Section 10-12. Obtaining a wastewater discharge permit does not relieve a permittee of its obligation to comply with all Federal and State pretreatment standards or requirements. 4.3 Wastewater Discharge Permitting Existing Connections Any industrial user which discharges industrial waste into the POTW prior to the effective date of this ordinance and who wishes to continue such discharges in the future, shall, within ninety ( 90 ) days after said date, apply to the City for a wastewater discharge permit in accordance with Section 4.5 below, and shall not cause and allow discharges to the POTW to continue after ninety ( 90 ) days of the effective date of this ordinance except in accordance with a wastewater discharge permit issued by the Director. 4.4 Wastewater Discharge Permitting Extrajurisdictional Industrial Users A. Any existing industrial user located beyond the City limits shall submit a wastewater discharge permit application, in accordance with Section 4.6 below, within ninety ( 90 ) day of the effective date of this ordinance. New industrial users located beyond the City limits shall submit such applications to the Director ninety ( 90 ) days prior to any proposed discharge into the POTW. B. Alternately, the Director may enter into an agreement with the neighboring jurisdiction in which the industrial user is located to provide for the implementation and enforcement of the pretreatment program requirements against said industrial user. 4.5 Wastewater Discharge Permit Application Contents In order to be considered for a wastewater discharge permit the permittee must submit the information required by Section 6.1 ( b ) of this ordinance. When a pretreatment process is required, plans must be submitted and stamped by a registered professional engineering license to practice in the State of Texas. The Director shall approve a form to be used as a permit application. In addition, the following may be requested: ~ Description of activities, facilities, and plant processes on the premises, including a list of all raw materials and chemicals used or stored at the facility which are, or could accidentally or intentionally be, discharged to the POTW. ~ Number of employees, type of operation, and proposed or actual hours of operation. ~ Each product produced by type, amount, process or processes, and rate of production. 16
