<br />e <br /> <br />e <br /> <br />C. The City may require the industrial user to install monitoring equipment as <br />necessary. The facility's sampling and monitoring equipment shall be <br />maintained at all times in a safe proper operating condition by the <br />industrial user at its own expense. All devices used to measure <br />wastewater flow and quantity shall be calibrated annually to ensure <br />accuracy. <br /> <br />D. Any temporary or permanent obstruction to safe and easy access to the <br />industrial facility to be inspected and/or sampled shall be promptly <br />removed by the industrial user at the written or verbal request of the <br />Superintendent and shall not be replaced. The costs of clearing such <br />access shall be born by the industrial user. <br /> <br />E. Unreasonable delays in allowing the City personnel access to the industrial <br />user premises shall be a violation of this ordinance. <br /> <br />7.2 Search Warrants <br /> <br />If the Director's authorized representative has been refused access to a building, <br />structure or property or any part thereof, and, if the Director's authorized <br />representative has demonstrated probable cause to believe that there may be a. <br />violation of this ordinance, or that the need to inspect as part of a routine <br />inspection program of the City designed to verify compliance with this ordinance <br />or any permit or order issued hereunder , or to protect the overall public health, <br />safety and welfare of the community, then upon application by the City Attorney, <br />the Municipal Court Judge of the City may issue a search and/or seized warrant <br />describing therein the specific location subject to the warrant. The warrant shall <br />specify what, if anything, may be searched and/or seized on the property <br />described. Such warrant shall be served at reasonable hours by the City Marshal. <br />In the event of an emergency affecting public health, safety and welfare, <br />inspection shall be made without issuance of a warrant. <br /> <br />SECTION 8 CONFIDENTIAL INFORMATION <br /> <br />8.1 Information and data on an industrial user obtained from reports, surveys, <br />wastewater discharge reports and monitoring programs, and from City inspection <br />and sampling activities, shall be available to the public without restriction unless <br />the industrial user specifically requests, and is able to demonstrate to the <br />satisfaction of the City, that the release of such information would divulge <br />information, processes or methods or production entitled to protection as trade <br />secrets under applicable State law. When requested and demonstrated by the <br />industrial user furnishing a report that such information should be held <br />confidential, the portions of a report which might disclose trade secrets, or secrets <br />processes shall not be available for inspection by the public, but shall be made <br />29 <br />
