Area Map Budgeted Item: _YES -LNO SUMMARY & RECOMMENDATION The City has received an application from DFMA Properties, Inc. (represented by Bart Latimer) to vacate, abandon and close the alley in Block 682, La Porte. The applicant seeks to close the alley in order to create a single economic unit of land to facilitate future development. Upon review of the application, each of the City's franchised utility companies (i.e. Centerpoint Energy, SBC & Time Warner Communication) as well as the Public Works Department has expressed no objection to the closing of the subject alley. In accordance with Section 62.35 of the Code of Ordinances, Staff has arranged for an independent appraisal to be conducted of the Right-Of-Way in question. As a result, the fair market value of the alley has been assessed at $0.90 per square foot. The City has subsequently received payment from the applicant in the amount of $4,320 (75% of Fair Market Value as per the ordinance) for the closing which contains a- total of 6,400 square feet. Recommendation: Staff recommends that City Council approve an ordinance vacating, abandoning, and closing the alley in Block 682, La Porte as petitioned by the applicant.
