This request is for the property located in the 700 Block of State <br />Highway 146 near Barbour's Cut Boulevard. The subject tract comprises 2.520 acres of land, described as TR 1, Block 4, <br />Nebraska Syndicate, Johnson Hunter Survey, Abstract No. 35, La Porte, Harris County, Texas. The tract is bounded by <br />Fairlane Street to the north, S.H.146 to the east, Bayshore Motel to the south, and North 11th Street (a half paved street) to <br />the west. The La Porte Terrace, a single-family subdivision, is across the street to the west. The applicant is requesting a <br />rezone from General Commercial (GC) to Business Industrial (BI) for proposed development of a truck stop. <br /> <br />As per Section 106-441, Table A, Commercial Uses, allows service stations (SIC#554) but excludes truck stops. While, <br />the Business Industrial (HI) zone across S.H. 146 seems compatible to the development of a truck stop, the adjacent <br />residences to this site make proposed rezone incompatible. The development within the subject tract may negatively <br />impact the surrounding properties and may harm the value of nearby properties. <br /> <br />As required by Ordinance, twenty-three (23) notices of public hearing were mailed to property owners within 200' of the <br />site. Fifteen responses received, all opposed to the project. Granting this requested change would be in contrary to the <br />goals and objectives ofthe La Porte Comprehensive Plan. <br /> <br />The Planning and Zoning Commission, by a unanimous vote (6-0) recommends to City Council denial of Rezone Request <br />#R04-005. <br /> <br />Action Required bv Council: <br />1. Conduct public hearing. <br />2. Consider taking action on an Ordinance for 2.520 acres of land located in the 700 block of S.H.146 to be rezoned <br />from GC to HI as requested by Ajay Jain. The applicant seeks to rezone the property for a proposed development of a <br />truck stop. <br />3. P&Z recommended denial of the request by a 6-0 vote.
