Ordinance for San. Sewer Service Agreement
B. Sanitary Sewer Service Agreement
C. Area Map

Budgeted Item: _YES -X-NO

SUMMARY & RECOMMENDATION

GWB Investments, L.P. has approached the City for a Sanitary Sewer Service Agreement (SSSA) for "Best
Trucking", a 32.3303 acre site located at 13225 Baypark Road in the City's Bayport District (see Exhibit "F"
- Area Map). At its August 27, 2007 meeting, Council approved an Industrial District Agreement (IDA) and
Water Service Agreement (WSA) with the company.

Council has approved a policy to provide water and sanitary sewer service to companies located outside the
city limits and within the City's industrial districts. These companies are required by the policy to execute
and maintain an Industrial District Agreement with the City. GWB Investments, L.P. desires to obtain
sanitary sewer service under the terms of this policy.

Based on the company's stated demand for domestic and industrial process uses, the average daily
demand for sewer is 10,500 gpd which is within the policy's limit of 30,000 gallons per day. This demand
includes utilization of 5,000 gpd of water for the company's truck washing operations. The applicant will pay
one and one-half (1-%) times the City's current utility rate. Additionally, GWB Investments, L.P. is subject to
a one-time connection fee for its Sanitary Sewer Service Agreement in the amount of $11,000 for which
payment has subsequently been received.

The term of the company's SSSA expires on December 31, 2007, plus any renewals and extensions
thereof. However, the agreement shall automatically expire at such time as there is no effective IDA
between the parties or, if the city exercises the right of termination.

Staff recommends approval of a Sanitary Sewer Service Agreement with GWB Investments, Inc. as
submitted herein.

Action Required bv Council:

Approve an ordinance authorizing the City to enter into a Sanitary Sewer Service Agreement with GWB
I tments, L.P.

Ron Bottoms, City Manager

-.1/ /~/"1

Date
