The request was made by Mr. Ken Schick for 19.6505 acres ofland located in the Richard <br />Pearsal Survey, Abstract 625, La Porte Outlets, City of La Porte, Harris County, T.exi'lS.The subject tract is located to the east of <br />Spencer Landing Subdivision. Currently, the property is zoned High Density Residential (R-3) and Large Lot Residential (LL). The <br />property is in the vicinity of single-family residential and commercial establishments. Being located at the intersection of Bay Area <br />Boulevard and opening of this roadway from Fairmont Parkway to Spencer Highway has encouraged the applicant to re-evaluate his <br />options for the development of entire 31 acre tract as commercial/retail center. <br /> <br />The Buxton Study, a commercial study 00 La Porte, has analyzed three sites selected by the City f()f vossible retail deveWpment and <br />revitalization in order to attract commercial developments in the area. The intersection of Spencer Highway at Bay area Boulevard is <br />among the sites selected. The opening of Bay Area Boulevard from Fairmont Parkway to Spencer Highway and the proposed <br />widening of Sens Road to State Highway 225, has prompted the owner/developer to consider providing commercial/retail at this <br />intersection. Commercial activities and tax components are to be favorably considered while reviewing this rezone request. The <br />subject site is also hampered by the pipeline easement and requires a creative design for land development. The tract in question <br />seems to be suitable for commercial classification. <br /> <br />In the past, there were attempts for proposed multi-family and/or tax credit housing developments at this site. The Homeowner's <br />Association (ROA) voiced their concerns. The applicant has had several meetings with the HOA prior to the formal request for <br />rezoning of the subject tract. HOA has expressed their support for this plan and submitted a letter in this regard. A copy is attached <br />herewith. As a reminder, rezoning must be unconditional and without any stipulations. The width of the planting strip may provide <br />adequate buffer and open space to minimize any adverse effects of commercial activities on adjacent residential uses (Spencer <br />Landing Subdivision). In addition, the Ordinance requires that parking lot lighting must be arranged so as to deflect lights away from <br />any adjoining residential zone or from public right-of-way, in compliance with Section 106-521(a) of the Code of Ordinances. <br /> <br />As required by Ordinance, forty-one notices of public hearing were mailed to property owners within 200' of the site. One response, <br />in favor of the proposed rezone, was received. Granting this requested change should not be contrary to the goals and objectives of <br />the La Porte Comprehensive Plan. <br /> <br />The Planning and Zoning Commission, by a unanimous vote (4-0), recommends City Council approval of Rezone Request #R06-004. <br /> <br />Action Required bv Council: <br /> <br />I.
