<br />e <br /> <br />e <br /> <br />RESOLUTION NO. 91-05 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT <br />WITH THE LAW FIRM OF WINSTEAD, SECHREST & MINICK TO REPRESENT THE <br />CITY OF LA PORTE IN CONNECTION WITH THE PENDING APPEAL OF THE TEXAS <br />WATER COMMISSION DECISION ON THE APPLICATION OF HOUSTON CHEMICAL <br />SERVICES, INC. FOR A HAZARDOUS WASTE FACILITY PERMIT; MAKING <br />APPROPRIATION OF FUNDS FOR SAID AGREEMENT; FINDING COMPLIANCE WITH <br />THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte has <br />heretofore authorized the City Manager of the City of La Porte to <br />enter into, on behalf of the City of La Porte, an agreement with the <br />law firm of Winstead, Sechrest & Minick, dated February 26, 1990, <br />and an addendum to said agreement, dated September 24, 1990. <br />Section 2. The City Manager is hereby authorized and directed <br />to execute, on behalf of the City of La Porte, a further addendum to <br /> <br />the February 26, 1990, and September 24, 1990, Fee Agreements <br />between the City of La Porte and the law firm of Winstead, Sechrest <br />& Minick, which addendum shall provide for said law firm to <br />represent the City of La Porte in connection with the pending appeal <br /> <br />of the Texas Water Commission decision on the application of Houston <br /> <br />Chemical Services, Inc., for a hazardous waste facility permit. <br /> <br />Section 3. The City Council of the City of La Porte hereby <br />authorizes the payment of $135,000.00 from the General Fund, Legal <br /> <br />Budget, to the law firm of Winstead, Sechrest & Minick. <br /> <br />Section 4. The City Council officially finds, determines, <br /> <br />recites and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br /> <br />posted at a place convenient to the public at the City Hall of the <br /> <br />City of La Porte, Texas for the time required by law preceding this <br />meeting, as required by the Open Meetings Law, Article 6252-17, <br /> <br />Texas Revised Civil Statutes Annotated; and that this meeting has <br /> <br />been open to the public as required by law at all times during which <br /> <br />this resolution and the subject matter thereof has been discussed, <br /> <br />considered and formally acted upon. The City Council further <br /> <br />ratifies, approves and confirms such written notice and the contents <br /> <br />and posting thereof. <br />
