<br />... <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 87-27 <br /> <br />A RESOLUTION ESTABLISHING THE POLICY OF THE CITY COUNCIL OF THE CITY OF LA <br />PORTEt ON THE ENFORCEMENT OF CITY OF LA PORTE ORDINANCE NO. 1559, "AN ORDINANCE <br />AMENDING CHAPTER FIVEt ANIMALS AND FOWL" t OF THE CODE OF ORDINANCES OF THE CITY <br />OF LA PORTE; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte has heretoforet on the <br /> <br />14th day of Septembert 1987t passed and approved Ordinance No. 1559t an ordinance <br /> <br />amending Chapter Five t "Animals and Fowl" t of the Code of Ordinances of the City <br /> <br />of La Porte. Certain questions have arisen as to the policies and procedures to <br /> <br />be followed in the enforcement of such ordinance. The purpose of this resolution <br /> <br />is to establish the policy of City Council on these matters. <br /> <br />Section 2. Section 5-38 of Ordinance No. 1559t provides that "No person <br /> <br />shall harbort at any timet more than three dogs or cats over the age of six <br /> <br />months each, in any place in the CitYt except a duly licensed and permitted <br /> <br />breeding kennelt boarding kennelt veterinary hospitalt or pet establishment." <br /> <br />It is the intention of City Council that persons residing in residentially zoned <br /> <br />areas of the City of La Portet who can show proof in the form of City of La Porte <br /> <br />registrationt or receipts from a veterinarian for rabies vaccinationt of more <br /> <br />than three dogs or catst on or before sixty (60) days from the date of this <br /> <br />Resolutiont shall not be deemed to be in violation of Section 5-38 of the <br /> <br />Ordinancet solely because the number of dogs or cats owned by such person was <br /> <br />more than threet on or before sixty (60) days from the date of this Resolutiont <br /> <br />and may continue to harbor such dogs or cats in excess of a total of three such <br /> <br />animalst for the remaining life of such dogs or cats in excess of threet owned by <br /> <br />such person and properly registered with the City of La Portet on or before sixty <br /> <br />(60) days from the date of this Resolution. Such person shall not have the right <br /> <br />to exceed the maximum number of three dogs or cats. after the death or removal of <br /> <br />the number of such animals in excess of three. <br /> <br />Section 3. It is the intent of City Council that the provisions of Section <br /> <br />5-36, Barking Dogs, and the provisions of Section 5-38, Restricting the Number of <br /> <br />Dogs and Cats in Proximity to Residence of Another, shall be enforced on a <br /> <br />complaint basis only. It is further the intent of City Council that, in the <br /> <br />event of such complaint, that City Humane Officers shall attempt to mediate the <br /> <br />matter between the complainant and the owner of the animals in question, prior to <br /> <br />filing charges against the owner. <br /> <br />Section 4. This Resolution shall be effective upon its passage and <br /> <br />approval. <br />
