HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 561, is hereby granted <br /> subject to the terms and conditions set forth in Exhibit B attached hereto (the "Consent <br /> Conditions"),and incorporated herein for all purposes. <br /> Section 3. That the Utility Agreement by and between the City and Beazer <br /> Homes Texas, L.P. on behalf of proposed Harris County Municipal Utility District No. <br /> 561, a copy of which is attached hereto as Exhibit C and incorporated herein for all <br /> purposes, is hereby approved and the Mayor of the City is hereby authorized to <br /> execute the Agreement on behalf of the City. <br /> Section 4. All ordinances or parts of ordinances inconsistent or in conflict <br /> herewith are, to the extent of such inconsistency or conflict, hereby repealed. <br /> Section 5. In the event any clause, phrase, provision, sentence, or part of this <br /> Ordinance or the application of the same to any person or circumstance shall for any <br /> reason be adjudged invalid or held unconstitutional by a court of competent <br /> jurisdiction, it shall not affect , impair, or invalidate this Ordinance as a whole or any <br /> part or provision hereof other than the part declared to be invalid or unconstitutional; <br /> and the City Council of the City of La Porte, Texas, declares that it would have passed <br /> each and every part of the same notwithstanding the omission of any such part. <br /> Section 6. The City Council officially finds, determines, recites and declares <br /> that a sufficient written notice of the date, hour, place and subject of this meeting of <br /> the City Council is posted at a place convenient to the public at the City Hall of the <br /> city for the time required by law preceding this meeting, as required by Chapter 551, <br /> TX. Gov't Code; and that this meeting has been open to the public as required by law <br /> 685194_2 <br />
