<br />~ <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 88-J[ <br /> <br />A RESOLUTION FINDING THE PUBLIC NECESSITY FOR THE ACQUISITION <br />OF CERTAIN PROPERTY FOR SANITARY LANDFILL PURPOSES~ AUTHORIZING THE <br />CITY ATTORNEY OF THE CITY OF LA PORTE TO ACQUIRE SAID PROPERTY BY <br />NEGOTIATION WITH THE OWNERS THEREOF, OR BY PROCEEDINGS IN EMINENT <br />DOMAIN. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />WHEREAS, the City Council of the City of La Porte has found and <br /> <br />determined that public necessity requires the location, construc- <br /> <br />tion, operation and maintenance of sanitary landfill and resource <br /> <br />recovery facilities on the hereinafter described real property, in <br />the City of La Porte, Barris County, Texas~ and <br /> <br />WHEREAS, the City Council of the City of La Porte has found and <br /> <br />determined that the fee simple title in and to the hereinafter <br /> <br />described real property is suitable and needed for such purpose, and <br /> <br />that it is necessary to acquire same for the construction of such <br /> <br />sanitary landfill and resource recovery facilities, as aforesaid~ <br /> <br />and <br /> <br />WHEREAS, the City Council of the City of La Porte deems it <br /> <br />advisable to authorize, and does hereby authorize Knox W. ASkins, <br /> <br />its City Attorney, to represent it in the acquisition of the <br /> <br />hereinafter described property: <br /> <br />Section l. That the said Knox W. Askins, as City Attorney for <br /> <br />the City of La Porte, be and he is hereby authorized to negotiate <br /> <br />with the owners of the hereinafter described land, concerning the <br /> <br />acquisition by the City of La Porte of the fee simple title thereto, <br /> <br />at the fair market value for same, and, should said legal counsel, <br /> <br />as duly authorized representative of the City of La Porte, be unable <br /> <br />to agree with such owners as to the fair market value of such fee <br /> <br />simple title, then, and in that event, said City Attorney for the <br /> <br />City of La Porte be, and he is hereby, authorized and directed to <br />file against all owners and lienholders, proceedings in eminent <br /> <br />domain to acquire the fee simple title to the hereinafter described <br /> <br />real property, for sanitary landfill and resource recovery purposes, <br /> <br />to wit: <br /> <br />That certain 80.972 acre tract, being part of a 203.713 <br />acre tract, in the George B. McKinstry League, A-47, <br />Harris County, Texas, being more particularly described <br />by metes and bounds on Exhibit nAn attached hereto, and <br />incorporated by reference herein. <br />
