<br />RESOLUTION NO. 88-10
<br />
<br />A RESOLUTION CONSENTING TO THE VACATING, ABANDONING, AND
<br />CLOSING BY THE CITY COUNCIL OF THE CITY OF MORGAN'S POINT, OF THAT
<br />PORTION OF THE RIGHT-OF-WAY OF NORTH "H" STREET, LYING AND BEING
<br />SITUATED BETWEEN THE EAST PROPERTY LINE OF NORTH BROADWAY, AND THE
<br />WEST PROPERTY LINE OF 9TH AVENUE, AND BETWEEN BLOCKS 474, 475, 456,
<br />AND 457, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS~ RELINQUISHING ALL
<br />RIGHTS OF THE CITY OF LA PORTE IN AND TO SAID RIGHT-OF-WAY~ FINDING
<br />COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN EFFECTIVE
<br />DATE HEREOF.
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
<br />
<br />Section 1. The City of La Porte is the record owner of the
<br />real property known as Blocks 474, and 475, Town of La Porte, Harris
<br />
<br />County, Texas, which abutts the North Boundary of the hereinafter
<br />
<br />described portion of the right-of-way of North "H" Street, in the
<br />
<br />City of Morgan's Point, Texas. The record owner of the property
<br />
<br />abutting said portion of the right-of-way of North "H" Street, to
<br />the south thereof, being Blocks 456 and 457, Town of La Porte,
<br />
<br />Harris county, Texas, has made application to the City of Morgan's
<br />
<br />Point, requesting the City Council of the City of Morgan's Point to
<br />
<br />vacate, abandon and close the hereinafter described portion of the
<br />
<br />right-of-way of North "H" Street.
<br />
<br />Section 2. The City Council of the City of La Porte, by this
<br />
<br />Resolution, hereby consents to the closing of the hereinafter
<br />
<br />described portion of the right-of-way of North "H" Street:
<br />
<br />That portion of the right-of-way of North "H" Street,
<br />in the City of Morgan's Point, Harris County, Texas,
<br />lying and being situated between Blocks 474 and 475,
<br />Town of La Porte, Harris County, Texas, on the North~
<br />Blocks 456 and 457, Town of La Porte, Harris County,
<br />Texas, on the South~ and extending from the East right-
<br />of-way of North Broadway Street, to the West right-of-
<br />way of 9th Avenue, and being a tract of land containing
<br />47,360 square feet.

<br />The City Secretary of the City of La Porte is hereby instructed to
<br />
<br />deliver a certified copy of this Resolution to the City Secretary of
<br />the City of Morgan's Point, to evidence the consent of the City of
<br />
<br />La Porte, on the following terms and conditions:
<br />
<br />(a) If the City of Morgan's Point waives closing fees for
<br />governmental agencies as does the City of La Porte, then the City of
<br />
<br />La Porte will retain the rights and usage of the Northern one-half
<br />
<br />of the "H" Street right-of-way.
