<br />. . <br /> <br />RESOLUTION NO. 92 - /3 <br /> <br />A RESOLUTION AUTHORIZING AND APPROVING A CONTRACT BY AND BETWEEN <br />THE CITY OF LA PORTE AND THE LA PORTE AREA WATER AUTHORITY FOR THE <br />SUPPLY OF WATER AND THE CONSTRUCTION, FINANCING AND OPERATION OF <br />WATER TREATMENT TRANSMISSION AND DISTRIBUTION FACILITIES. <br /> <br />WHEREAS, the City of La Porte has been mandated by the Harris- <br /> <br />Galveston Coastal Subsidence District to convert to surface water <br /> <br />by the year 1990~ <br /> <br />WHEREAS, the Authority has heretofore entered into Contracts <br /> <br />for the Supply of Potable Water and the Construction, Financing and <br /> <br />Operation of Water Transmission Facilities with the City of <br /> <br />Morgan's Point, the City of Shoreacres, the Bayshore Municipal <br /> <br />Utility District and all such Contracts and this Contract (collec- <br /> <br />tively, the "Water Sales Contracts") are substantially the same in <br /> <br />all material respects in their terms, conditions and provisions~ <br /> <br />WHEREAS, the City Council of the City of La Porte met in open <br /> <br />session on the 23rd day of November, 1987, and considered the <br /> <br />adoption of the Water Sales Contract between the La Porte Area <br /> <br />Water Authority and the City of La Porte~ and <br />WHEREAS, the Water Sales Contract between the La Porte Area <br /> <br />Water Authority and the City of La Porte was approved and adopted <br />by the City Council of the City of La Porte at said meeting~ and <br /> <br />the Mayor of the City of La Porte and the City Secretary of the <br /> <br />City of La Porte were authorized to sign and attest said Contract <br /> <br />in their respective capacities~ and <br /> <br />WHEREAS, the Authority and the City of La Porte are authorized <br /> <br />to enter into this Contract pursuant to Chapter 729, page 2678, <br /> <br />Acts of the 67th Legislature of the State of Texas, Regular <br />Session, 1981, V.A.T.C.S. Article 4413 (32c), and other applicable <br /> <br />laws, now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF LA PORTE, THAT: <br /> <br />Section 1. <br /> <br />That a contract by and between the City of La <br /> <br />Porte and the La Porte Area Water Authority, a copy of which is <br /> <br />attached hereto as Exhibit "A" and incorporated by reference <br /> <br />herein, be and is hereby authorized, ratified and approved and the <br /> <br />signatures of the Mayor of the City of La Porte and the City Page <br />
