<br />provided herein~ <br /> <br />\ <br /> <br /> <br />(~cause its engineers to prttare detailed plans and <br /> <br />specifications for the construction of the Transmission System and <br /> <br />Distribution System~ and (c) obtain the approval of all such plans and <br />specifications by the Texas Department of Health and all other govern- <br /> <br />mental agencies having jurisdiction. <br /> <br />Section 2.03 The pro rata share of each Participant in the <br /> <br />actual construction cost of the Transmission System and ~he Distribution <br /> <br />System shall be calculated when sufficient engineering and cost data <br /> <br />are available to the Authority. Each Participant, including the City, <br /> <br />shall approve the finalized construction cost formula and the City's <br /> <br />share of the actual construction cost for the Transmission System and <br /> <br />Distribution System to be paid by the City and the other Participants, <br /> <br />t:>rior to the .a.uthority's sale of bonds to finance the Distribution <br /> <br />System and Transmission System. <br /> <br />Section. 2.04 It is ext:>ressly understood and agreed t.hat <br /> <br />the acquisition of land, easements, and rights-of-way, the awarcing of <br /> <br />Contracts, the apt:>roval of plans and specifications and the approval of <br /> <br />changes in said plans and specifications, and the supervision of <br /> <br />construct ion of the Southeast Plant, the Transmiss ion System, and the <br /> <br />Distribution System are solely within the discretion and control of the <br /> <br />Authority. <br /> <br />Section 2.05 It is expressly understood and agreed that any <br /> <br />obligation on the part of the Authority to acquire, construct, improve, <br /> <br />enlarge, extend, repair, complete or operate the Authority's share of <br /> <br />the Southeast Plant, the Transmission System, and the Distribution <br /> <br />System shall be subject to: <br /> <br />-8- <br />
