<br />el <br /> <br />- <br /> <br />whereupon title to, possession and control of, and responsibility for <br /> <br />all such Water shall immediately pass to and vest in the Ci ty. Each <br />party hereto shall save and hold the other harmless from all claims, <br /> <br />demands and causes of action which may arise while said Water is under <br /> <br />its ownership and control. <br /> <br />Section 4.04 <br /> <br />It is recognized and understood by both parties to <br /> <br />this Contract that the Ci ty now owns and operates a system of wells <br /> <br />producing Water and that the City may elect to attempt to acquire and <br />operate addi tional wells, subject to the approval of all regula tory <br /> <br />authorities. While nothing in this Contract shall obligate the City to <br /> <br />continue the operation of its own Water wells, the Ci ty nevertheless <br />agrees that the \oJater supplied hereunder will be its principal source <br /> <br />of Water, and if it continues the operation of its own Water wells, <br /> <br />the City will coordinate the production therefrom in such manner a~ t6 <br />minimize large daily fluctuations in the quantity of Water taken under <br /> <br />this Contract. <br /> <br />ARTICLE V <br />Metering Equipment <br /> <br />Section 5.01 The Authority shall install, operate and maintain at <br /> <br />its expense the necessary measuring equipment of standard type for <br /> <br />measuring properly the quantity of Water delivered under this Agreement. <br /> <br />Such measuring equipment shall be located on Authority's supply main at <br /> <br />each point of delivery. Such meter or meters and other equipment so <br /> <br />installed shall remain the property of Authority. Each of the partici- <br /> <br />pants shall have access to such measuring equipment at all reasonable <br /> <br />times, to inspect and to employ an independent laboratory to check <br />measuring equipment, but the reading, calibration and adjustment thereof <br /> <br />-17- <br />
