ORDINANCE AUTHORIZING AND ORDERING THE ISSUANCE OF CITY OF LA PORTE, TEXAS, PUBLIC PROPERTY FINANCE CONTRACTUAL OBLIGATIONS, SERIES 2006; AND CONTAINING OTHER MATTERS INCIDENT THERETO BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: ARTICLE I FINDINGS AND DETERMINATIONS Section 1.1: Findings and Determinations. The City Council hereby officially finds and determines that: (a) The City of La Porte, Texas (the "City"), acting through its City Council, is authorized by its Home Rule Charter and the Constitution and laws of the State of Texas, particularly the Public Property Finance Act, Chapter 271, Subchapter A, Texas Local Government Code, as amended (the "Act"), to execute, perform and make payments under contracts with any person for the use, purchase or other acquisition of personal property, or the financing thereof, as described in the Act; (b) The Act permits the City Council of the City to execute contracts in any form deemed appropriate by the City Council in connection with the use, purchase or other acquisition of personal property; (c) The City Council of the City desires to purchase personal property, described in Exhibit A attached hereto, or such other personal property, appliances, equipment, facilities, furnishings or interests therein, whether movable or fixed, deemed by the City Council to be necessary, useful and/or appropriate for the purposes of the City; and (d) The City Council of the City is of the opinion and hereby affirmatively finds that it is in the best interests of the City to adopt this Ordinance and issue the obligations herein authorized as permitted by the Act. ARTICLE II DEFINITIONS AND INTERPRETATIONS Section 2.1: Definitions. As used herein, the following terms shall have the meanings specified, unless the context clearly indicates otherwise: "Act" shall mean Chapter 271, Subchapter A, Texas Local Government Code, as amended.
