<br />ORDINANCE NO. 96-2079-L <br /> <br />AN ORDINANCE ADOPTING THE 2008 EDITION OF THE NATIONAL ELECTRICAL <br />CODE BY AMENDING CHAPTER 82 OF THE CODE OF ORDINANCES OF THE CITY OF <br />LA PORTE, CHAPTER 82 "BUILDINGS AND BUILDING REGULATIONS," ARTICLE IV <br />"ELECTRICAL CODE", DIVISION 5 "STANDARDS", SECTION 82-336 "NATIONAL <br />ELECTRICAL CODE - ADOPTION"; PROVIDING A REPEALING CLAUSE; <br />CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS <br />ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON <br />CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO THOUSAND <br />DOLLARS; PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />Section 1: That Chapter 82, "Buildings and Building Regulations," Article IV, "Electrical <br />Code" Division 5 "Standards", Section 82-336 "National Electrical Code - Adoption", of the <br />Code of Ordinances, La Porte, Texas, is hereby amended to read as follows: <br /> <br />"Sec. 82-336. National Electrical Code - Adoption. <br /> <br />(a) The National Electrical Code, 2008 Edition, is hereby adopted as the regulations to <br />govern and to be observed and followed in all electric wiring and in all electrical <br />construction, installation, repair, alteration, operation and maintenance of electric wiring, <br />apparatus and fixtures, except for the amendments adopted in Sections 82-337 through <br />82-350, of this Chapter. <br /> <br />(b) If a section of this article is found to be in conflict with a provision of any zoning, <br />building, fire, safety or health ordinance or any regulation adopted pursuant thereto or <br />any other ordinance or code or regulation of the city, the provision which establishes the <br />higher standard for the promotion of the health and safety of the people shall prevail. <br /> <br />(c) Any person who shall violate any provision of the standards adopted or established in this <br />article shall be deemed to have committed a Class C misdemeanor and upon conviction <br />shall be punished by a fine in an amount as provided in Appendix B of this Code. <br /> <br />(d) All applicable fees shall be in accordance with Appendix A of this Code." <br /> <br />Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are <br />hereby repealed; provided, however, that such repeal shall be only to the extent of such <br />inconsistency and in all other respects this ordinance shall be cumulative of other ordinances <br />regulating and governing the subject matter covered by this ordinance. <br />
