<br />AGREEMENT BY AND BETWEEN <br />THE CITY OF LA PORTE, TEXAS, AND <br />LA PORTE REDEVELOPMENT AUTHORITY <br /> <br />THE STATE OF TEXAS ~ <br />~ <br />COUNTY OF HARRIS ~ <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />This agreement (the "Agreement") is made by and between the CITY OF LA PORTE, <br /> <br />TEXAS, a municipal corporation and a home-rule city of the State of Texas (the "City"), and the <br /> <br />LA PORTE REDEVELOPMENT AUTHORITY, a local government corporation created and <br /> <br />organized under the provisions of the Texas Tnmsportation Corporation Act, Chapter 431, <br /> <br />Subchapter D, Transportation Code and existing under the laws of the State of Texas (the <br /> <br />"Authority"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, by City of La Porte Resolution No; 2007-02 the City authorized and <br /> <br />established the Lakes at Fairmont Greens Public Improvement District (the "Pill") under the <br /> <br />provisions of Chapter 372, Texas Local Government Code; and <br /> <br />WHEREAS, by City of La Porte Resolution. No. 2000-2457 approved on December <br /> <br />11 th, 2000, the City authorized the creation of the Authority pursuant to the provisions of <br /> <br />Subchapter D of Chapter 431, Texas Transportation Code and Chapter 394, Texas Local <br /> <br />Government Code to aid, assist, and act on behalf of the City in the performance of the City's <br /> <br />governmental functions relating to the management and administration of the PID; and <br /> <br />WHEREAS, it is necessary for the City to use the Assessments collected for the purpose <br /> <br />of carrying out and completing the services and improvements proposed in the Service Plan; and <br /> <br />WHEREAS, the City desires for the Authority to aid and assist the City in collecting <br /> <br />Assessments against benefited properties and in carrying out and completing the services and <br /> <br />improvements proposed in the Service Plan; and <br /> <br />HOU:2680299.1 <br />
