<br />The Subrecipient agrees to abide by the provisions of 24 C.F.R. 570.611 with <br />respect to conflicts of interest, and covenants that it presently has no financial <br />interest and shall not acquire any financial interest, direct or indirect, which would <br />conflict in any manner or degree with the performance of services required under <br />this Agreement. The Subrecipient further covenants that in the performance of <br />this Agreement no person having such a financial interest shall be employed or <br />retained by the Subrecipient hereunder. These conflict of interest provisions apply <br />to any person who is an employee, agent, consultant, officer, or elected official or <br />appointed official of the Grantee, or of any designated public agencies or <br />subrecipients that are receiving funds under the CDBG Entitlement program. <br /> <br />The Subrecipient also agrees to abide by 18 D.S.C. 286, which provides for <br />conspiracy to defraud the Federal Government with Respect to Claims. In <br />addition, the Subrecipient will also abide by the False Claims Act (31 D.S.C. 3729 <br />et seq.), 18 US.c. 287 relating to False, Fictitious and Fraudulent Claims, 18 <br />D.S.C. 245 Federally Protected Activities, 18 D.S.C. 1001 regarding General <br />Statements or Entries, the Program Fraud Civil Remedies Act (31 US.C. 3801- <br />3812), the Federal Claims Collection Act of 1966 (31 D.S.C. 952) as amended by <br />the Derby Collection Act of 1982, the Meritorious Claims Act (31 D.S.C. 3702), <br />the Tucker Act (28 US.C. 1346, 1491, and 2501), the Wunderlich Act (41 D.S.C. <br />321-322), the Anti-Deficiency Act (31 D.S.C. 1341), and Section 208(a) of the <br />Intergovernmental Personnel Act of 1970, as amended. <br /> <br />4. Subcontracts <br /> <br />a. Approvals <br /> <br />The Subrecipient shall not enter into any subcontracts with any agency or <br />individual in the performance of this Agreement without the written <br />consent of the Grantee prior to the execution of such agreement. <br /> <br />b. Monitoring <br /> <br />The Subrecipient will monitor all subcontracted services on a regular basis <br />to assure contract compliance. Results of monitoring efforts shall be <br />summarized in written reports and supported with documented evidence of <br />follow-up actions taken to correct areas of noncompliance. <br /> <br />c. Content <br /> <br />The Subrecipient shall cause all of the provisions of this Agreement in its <br />entirety to be included in and made a part of any subcontract executed in <br />the performance of this Agreement. <br /> <br />18 <br />
