<br />l <br /> <br />......... <br />" <br /> <br />1 INTERLOCAL AGREEMENT <br />FOR DEBRIS REMOVAL AND DISPOSAL SERVICES <br /> <br />This' Agreement is made all this it!:' day of 5eat,c:)~ between the City of La Porte, <br />Harris ComIty, Texas, and Harris ComIty, Texas, a body:ct;iJ)orate and'politic under. the. laws of the ' <br />State of Texas. <br /> <br />WITNES SETH <br /> <br />Whereas, Harris County and the La Porte are authorized to enter into an agreement to <br />contract with eligible .entities to perform governmental functions and services, including the <br />.. purchase of goods and services pursuant to and illlder th~ provisions 'of Tex. Goy't Code Ann. <br />~791.001 et seq (Vernon 1994 & Supp. 2003), also known as "The Intcrlocal Cooperation Act"; and, <br /> <br />Whereas, in reliance on such Act, Harris County and the La Porte desire to permit the debris <br />removal and disposal services. <br /> <br />Now therefore, the parties hereto, mutually agree to the following:!. <br /> <br />The City of La Porte ("La Portell) hereby designates it's Emergency Management <br />Coordinator and Assistant Director of Public Works to act illlder the direction and on behalf of La <br />Porte for debris removal and disposal services pursuant to Harris ComIty's Agreement with Omni <br />Pinnacle, LLC (Omni), as primary contractor and DRC Emergency Services, LLC (DRC), as <br />secondary contractor, which was let in accordance with Chapter 252 of the Texas Local Government <br />Code and all other applicable laws and which agreement is attached hereto as Exhibit "A" and <br />incorporated. herein for ~l intents and purposes <br /> <br />II. <br /> <br />La Porte, by execution of this Agreement; agrees to directly pay Omni and/or DRC upon <br />1'eceipt of goods and/or completion of work specified for La Porte's debris removal and disposal <br />~ervices, according to the description contained herein. and after receipt of a proper invoice, <br />therefore an amoWlt based upon the unit pricing detailed in Exhibit "A". <br /> <br />Neither Harris COilllty nor La Porte shall assume any responsibility or liability to pay for <br />materials plU'chased or services performed for the benefit of the other entity. La Porte's payment <br />required by tlus contract shall be made from current, available revenues, as approved by La Porte <br />City Council. Furthermore, both parties agree that no payrrienthas been, 01' will be made to.Hartis <br />County for any services or funct.ions requIred to be pcrformedwlder this Agteement. IiI'obtaining <br />the services of Omni and/or DRC, La Porte has relied solely- on its own inspections, investigations, <br />.and due diligence regarding the services and La Porte acknowledges that Han'is County has made no . <br />representations..or 'wan-anties .expressed or implied with respect to the services to be rendered. <br /> <br />III. <br />
