ORDINANCE NO 2006 -RAS <br />AN ORDINANCE AUTHORZING THE DESIGNATION OF THE CITY OF <br />LA PORTE REINVESTMENT ZONE "C" - "PREFERRED FREEZER <br />SERVICES HOUSTON PORT, LLC."; MAKING FINDINGS OF FACT; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br />BE IT ORDANIED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. The City Council of the City of La Porte has heretofore, on the 14th day of <br />February, 2005, adopted Ordinance No. 2005-2809, an Ordinance establishing guidelines and <br />criteria governing tax abatement agreements by the City of La Porte. A public hearing was held <br />before the City Council of the City of La Porte on November 6, 2006, pursuant to notice as <br />required by Section 312.201, Texas tax Codes, which notice was published not later than the 7th <br />day before the date of the hearing in the Bayshore Sun, a newspaper having general circulation in <br />the City of La Porte, a true and correct copy of said published notice being attached hereto as <br />Exhibit "A" and incorporated by reference herein; and pursuant to notice delivered in writing not <br />later than the 7th day before the hearing, to the presiding officer of the La Porte Independent <br />School District; to the County Judge of Harris County, Texas presiding officer of the Harris <br />County Commissioners Court, on behalf of Harris County, the Harris County Flood Control <br />District, the Port of Houston Authority of Harris County, and the Harris County Department of <br />Education; and to the presiding officer of the San Jacinto College District; being all of the taxing <br />units included in the proposed reinvestment zone. A copy of the notices to the La Porte <br />Independent School District and Harris County Commissioners Court, and the San Jacinto <br />College District, are attached hereto as Exhibits `B", "C", and "D", respectively, incorporated by <br />reference herein, and made a part hereof for all purposes. <br />Section 2. Specifically, and without limiting the generality of the foregoing, the City <br />Council of the City of La Porte finds, determines and declares that the subject property would be <br />reasonably likely as a result of the designation as a reinvestment zone, to contribute to the <br />retention or expansion of primary employment or to attract major investments in the zone that <br />would be a benefit to the property and that would contribute to the economic development of the <br />City of LaPorte. The City Council of the City of La Porte further finds, determines and declares <br />that the improvements sought are feasible and practical and would be a benefit to the land to be <br />included in the zone and to the City of La Porte after the expiration of an agreement into under <br />Section 312.204, Texas Tax Code. <br />
