<br />(To be paid monthly beginning 30 days after delivery of <br />water beginning on the date the Plant expansion begins <br />delivery of water.) <br /> <br />These New Debt Service Expenses and Untreated Water 0 & M Expense shall be paid and <br /> <br />administered in accordance with procedures applicable to 0 & M Expense as provided in the <br /> <br />Restated Agreement. <br /> <br />OTHER PROJECTS UN'FREA TED WATER PAYMENTS <br /> <br />For Participants who have selected the Other Projects Untreated Water Payments, O&M <br /> <br />Expenses under the Restated Agreement shall be charged for the Other Projects Water they take <br /> <br />by deleting the '(AlE x D) x (I + H)' term and the '(I x F)' term, but add the term '(AI x R)' <br /> <br />where R is the Managing Participants contract rate for untreated water. <br /> <br />As used herein: <br /> <br />"AI" is the amount of treated water taken by a Participant during a fiscal year in excess of <br /> <br />its Demand Allocation under the Restated Agreement. <br /> <br />"A2" is 3,650 million gallons for the Gulf Coast Water Authority, 365 million gallons per <br /> <br />year for the Clear Brook City Municipal Utility District, 6,022.5 million gallons per year for the <br /> <br />City of Pasadena and 2,190 million gallons per year for the City of Friendswood. <br /> <br />"B" means all costs and expenses incurred by the Managing Participant (whether <br /> <br />incurred by the Managing Participant through its own staff or by independent contractors) for the <br /> <br />maintenance and operation of the untreated water facilities during the fiscal year, including, (i) <br /> <br />chemicals, labor, power, testing, permits, insurance, and other related costs, necessary for the <br /> <br />efficient maintenance and operation of the untreated water facilities as required under the <br /> <br />Restated Agreement and all applicable regulatory requirements and the preparation of costs of <br /> <br />the annual audit; (ii) necessary repairs and replacements to the untreated water facilities; and (iii) <br /> <br />R\EWB\SOUTHE DOC <br /> <br />11 <br /> <br />9/19/2006 <br />
