<br />e <br /> <br />- 5- <br /> <br />e <br /> <br />in death or injury to self or others. Safety-sensitive positions requiring the operation of <br />commercial motor vehicles, as defined under 49 C.F.R~ Part 382, are subject to the City <br />of La Porte Commercial Motor Vehicle Substance Abuse Policy. <br /> <br />Security-sensitive duties means a position handling or having access to money, <br />negotiable instruments, sensitive information and similar assets that require a high <br />degree of protection. <br /> <br />Under the influence means a condition in which a person is affected by the use of a <br />drug and/or alcohol in any detectable manner. The symptoms of influence are not <br />confined to those consistent with misbehavior, nor to obvious impairment of physical or <br />mental ability, such as slurred speech or difficulty in maintaining balance. A <br />determination of being under the influence can be established by a professional <br />opinion, a scientifically valid test, such as, blood, or breath analysis. <br /> <br />5. Education <br /> <br />5.1 Supervisors and other management personnel are to be trained in: <br /> <br />a) Detecting the signs and behavior of employees who may be using drugs <br />and/or alcohol in violation of this policy. <br /> <br />b) Intervening in situations that may involve violations of this policy. <br /> <br />c) Recognizing the above activities as a direct job responsibility. <br /> <br />5.2 Employees and designated contract employees are to be informed of: <br /> <br />a) The health and safety dangers associated with drug and alcohol use. <br /> <br />b) The provisions of this poliCY. <br /> <br />6. Prohibited Activities <br /> <br />6.1 Illegal Drugs and Alcohol <br /> <br />a) The use, sale, purchase, transfer, or possession of an illegal drug and/or <br />alcohol by any employee during the course and scope of employment, <br />provided however; this does not prohibit consumption of alcohol on City <br />premises by off-duty employees when served under permit. <br /> <br />6.2 Legal Drugs <br /> <br />a) It will be the responsibility of any employee using a potentially impairing <br />legal drug, required for medical treatment or therapy, to inquire of their <br />
