<br />Mr. Stephen Barr <br />Fairmont Parkway Hike and Bike Trail <br />June 23, 2008 <br /> <br />HUITI -.IDLIARS <br /> <br />to review partial submissions or those for which submissions of correlated items have not <br />been received. <br />1.4.3 Make periodic observations of the work in progress (as distinguished from providing a full- <br />time Project Representative) and provide appropriate reports to the Client. In such <br />inspections and observations, HZ will endeavor to protect the Client against defects and <br />deficiencies in the work of contractors, but he does not guarantee the performance of their <br />contracts nor assume responsibility for construction means, methods, techniques, <br />sequences, procedures, or for safety precautions or programs in connection with the <br />construction work. HZ shall not be responsible for the acts or omissions of the Contractor, <br />or any subcontractor's agents or employees, or any other persons performing any of the <br />work. <br />1.4.4 Provide consultation and advice to the Client during construction. HZ shall be, in the first <br />instance, the interpreter of the requirements of the Contract Documents and the impartial <br />judge of the performance there under by both the Client and Contractor. HZ shall make <br />decisions on all claims of the Client or Contractor relating to the execution and progress of <br />the work. HZ's decisions in matters relating to artistic effect shall be final if consistent with <br />the intent of the Contract Documents. Clarifications, interpretations and decisions of HZ <br />shall be consistent with the intent of and reasonably inferable from the Contract Documents <br />and shall be in written or graphic form. In the capacity of interpreter and judge, HZ shall <br />endeavor to secure faithful performance by both Client and Contractor, shall not show <br />partiality to either, and shall not be liable for the result of any interpretation or decision <br />rendered in good faith in such capacity. <br />1.4.5 Assist Client in the selection of an independent testing laboratory to perform construction <br />materials testing. <br />1.4.6 Recommend Change Orders to Client, as appropriate, and prepare Change Orders as <br />required. <br />1.4.7 Based on observations of construction progress at the site and on a review of the <br />Contractor's Payment Request, HZ shall make recommendations to the Client relative to <br />progress payments. HZ shall not be deemed to represent that he has made any examination <br />to ascertain how and for what purpose the Contractor has used the moneys paid on account <br />of the contract sum. <br />1.4.8 Receive and review maintenance and operating instructions, schedules and guarantees and <br />transmit these documents to Client. <br />1.4.9 Make a Substantial Completion Inspection and a Final inspection of the completed Project <br />with the Client or his representative. <br />1.4.10 Provide a signed "Notice of Acceptability" that the Project work is acceptable to the best of <br />HZ's knowledge, information and belief and based upon the extent of services provided by <br />HZ under this Agreement. <br />1.4.11 Preparation of Record Drawings. Record Drawings shall be based upon based upon the <br />marked-up record drawings, addenda, change orders and other data furnished by the <br />Construction Contractor. These Record Drawings will show significant changes made <br />during construction. Because these Record Drawings are based on unverified information <br />provided by other parties, which HZ shall assume will be reliable, HZ, Inc. cannot and does <br />not warrant their accuracy. <br /> <br />1.5 TOPOGRAPHIC SURVEYING AND ABSTRACTING- <br /> <br />1.5.1 The City shall provide to HZ LiDAR information, abstracting, and GIS information that <br />contains at minimum deeds, plats, easement, and ground elevations suitable for design. <br /> <br />Page 3 of 10 <br />
